THE MOWING PANDA TERMS OF SERVICE

Effective Date: 9/25/2026
Version: 1.0

These Terms of Service (“Terms”) govern services provided by Great Name LLC, doing business as The Mowing Panda (“The Mowing Panda,” “we,” “us,” or “our”), and use of our website.

By approving an estimate, proposal, service authorization, or other agreement that references these Terms, the customer (“Customer”) agrees to these Terms. These Terms are incorporated into the Customer’s approved agreement with The Mowing Panda.

1. Estimates and Scope of Work

Services are limited to the work specifically identified in the Customer’s approved estimate, proposal, service package, or other written service description.

Any service, area, material, or task not specifically included is outside the scope of work and may require additional authorization and charges.

Customer requests made after approval do not modify the scope of work unless accepted by The Mowing Panda. Employees and crew members are not authorized to provide additional work without approval from The Mowing Panda.

2. Customer Instructions and Professional Judgment

Customers are responsible for communicating specific requirements before work is performed.

Unless specific measurements, heights, shapes, boundaries, methods, or other instructions are agreed upon in writing, the Customer authorizes The Mowing Panda to use reasonable professional judgment in performing the approved services.

Preferences or instructions communicated after work has been performed do not retroactively modify the approved scope of work.

3. Landscape Conditions and Living Materials

Lawns, plants, trees, shrubs, palms, and other landscaping are living materials affected by factors outside The Mowing Panda’s control, including species, age, previous maintenance, weather, irrigation, drainage, soil, pests, disease, environmental stress, and existing health.

The Mowing Panda does not guarantee the future health, growth, appearance, recovery, or survival of existing plants or turf unless a specific written guarantee is expressly included in the applicable agreement.

Normal landscape services may reveal previously concealed discoloration, bare areas, dead material, woody growth, weeds, disease, thinning, or other existing conditions.

4. Trimming and Pruning

Trimming and pruning may expose previously shaded growth, bare areas, woody stems, discoloration, irregular growth, or differences between old and new foliage. Plant appearance may change temporarily while new growth develops.

Unless specific instructions are included in the approved scope of work, trimming and pruning will be performed using reasonable professional judgment based on the plant’s existing size, condition, growth, accessibility, surrounding property, and the nature of the requested service.

Customers requesting a particular finished height, shape, density, privacy level, or appearance must communicate that requirement before work is performed and should ensure it is included in the approved scope of work.

Dissatisfaction with the appearance, height, shape, density, or amount of trimming does not, by itself, establish that a living plant has been damaged and does not automatically entitle the Customer to removal, replacement, reimbursement, or compensation.

5. Mowing and Turf Maintenance

Turf appearance and mowing results vary based on grass species, growth, weather, irrigation, drainage, soil, weeds, disease, pests, previous maintenance, and property conditions.

The Mowing Panda may adjust, postpone, skip, or decline service to an area when conditions make normal service unsafe or create an unreasonable risk of property or turf damage, including excessive saturation, flooding, severe overgrowth, debris, rocks, unstable ground, inaccessible areas, or other hazardous conditions.

Unless specifically included in the approved service, removal or collection of grass clippings is not included.

6. Weed Control, Fertilization and Chemical Applications

Chemical applications are subject to product label requirements, applicable law, weather, environmental conditions, plant conditions, and other circumstances affecting safe and effective application.

Results are not instantaneous. The Mowing Panda does not guarantee complete eradication or prevention of weeds, pests, disease, or undesirable vegetation.

The Customer is responsible for informing The Mowing Panda before treatment of sensitive plants, areas, restrictions, or conditions requiring special treatment that would not reasonably be apparent during normal service.

The Mowing Panda may postpone, modify, or decline an application when conditions make treatment unsafe, inappropriate, ineffective, or inconsistent with applicable requirements.

7. Property Access, Gates and Pets

The Customer is responsible for providing safe and reasonable access to all areas included in the service.

Gates must be unlocked or otherwise accessible when access is necessary. Pets must be safely secured away from areas being serviced.

The Customer is responsible for removing or identifying toys, hoses, decorations, furniture, cables, temporary irrigation, pet waste, and other objects that may interfere with safe service.

The Mowing Panda may skip inaccessible or unsafe areas. Employees are not required to enter an area containing an unsecured animal or another condition they reasonably believe presents a safety risk.

8. Irrigation, Utilities and Concealed Property

The Customer is responsible for informing The Mowing Panda of known underground, concealed, unusually placed, fragile, improperly installed, or inadequately protected property within service areas, including irrigation components, drainage systems, electrical wiring, landscape lighting, invisible pet fencing, cables, pipes, septic components, and similar installations.

The Mowing Panda is not responsible for damage to concealed, unmarked, improperly installed, inadequately protected, or otherwise not reasonably discoverable property during the ordinary performance of approved services, except to the extent responsibility cannot lawfully be limited.

9. Rocks, Debris and Projectiles

Landscape equipment can cause rocks, gravel, shells, glass, metal, toys, debris, and other objects located in lawns, beds, or service areas to become projectiles.

The Customer is responsible for informing The Mowing Panda of known hazardous debris and for maintaining service areas reasonably free of objects that may create an unusual hazard.

The Mowing Panda may decline to mow, string trim, edge, or otherwise mechanically service an area containing rocks, shells, debris, or other materials that create an unreasonable risk of injury or property damage and may recommend another method of maintenance.

10. Existing Conditions

The Mowing Panda is not responsible for damage, deterioration, disease, decline, defects, instability, improper installation, drainage problems, irrigation problems, pest activity, dead material, or other conditions that existed before our work or were not caused by our services.

The Mowing Panda may photograph or otherwise document property conditions before, during, or after service.

11. Weather, Scheduling and Service Frequency

Landscape services are weather dependent.

Rain, lightning, hurricanes, tropical weather, saturated ground, excessive heat, equipment failures, road conditions, governmental restrictions, staffing emergencies, and other circumstances may require service to be delayed, rescheduled, modified, or skipped.

Unless expressly guaranteed in writing, scheduled service dates and arrival times are estimates and may change.

Service frequency describes the anticipated frequency of visits and does not guarantee service on a particular calendar date or at a particular time.

12. Service Concerns and Damage Claims

Customers must report service concerns or alleged damage promptly after discovery and provide reasonable information and access necessary for evaluation.

The Customer agrees to take reasonable steps to prevent avoidable additional damage after discovering a potential problem.

Before repairing, removing, replacing, altering, disposing of, or hiring another provider to address property or landscaping allegedly damaged by The Mowing Panda, the Customer agrees to provide The Mowing Panda a reasonable opportunity to inspect the condition and, when appropriate, offer a reasonable correction or remedy.

This requirement does not apply when immediate action is reasonably necessary to address an imminent safety hazard or prevent additional material property damage.

The Customer should preserve the allegedly damaged property and reasonable evidence of the condition when practicable.

13. Remedies and Plant Replacement

If The Mowing Panda determines that corrective action is appropriate, the remedy will depend upon the circumstances and may include correction, reperformance, reasonable restoration, account credit, refund of the affected service, insurance handling where appropriate, or another reasonable remedy.

A living plant is not considered a total loss merely because trimming, pruning, treatment, weather, or temporary stress affects its appearance.

Removal or replacement of a plant is not an automatic remedy for dissatisfaction with its trimming, pruning, height, shape, density, appearance, or temporary condition.

The Mowing Panda must be given a reasonable opportunity to determine whether a plant or other item can reasonably recover, be corrected, or be repaired before replacement is considered, except where immediate action is reasonably necessary.

14. Limitation of Liability and Ordinary Landscape Risks

The Customer acknowledges that lawn care and landscape services involve ordinary and inherent risks, including temporary changes in plant appearance, turf disturbance, exposure of previously concealed conditions, and incidental effects associated with reasonable performance of the approved services.

To the fullest extent permitted by Florida law, The Mowing Panda is not responsible for loss or damage resulting from conditions, objects, utilities, irrigation components, plants, hazards, or property that were preexisting, concealed, unmarked, improperly installed, inadequately protected, or not reasonably discoverable during ordinary performance of the services.

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, THE MOWING PANDA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES, INCLUDING LOST PROFITS, LOSS OF USE, LOSS OF ENJOYMENT, OR DIMINUTION IN PROPERTY VALUE.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Recurring Services

Approval of an estimate or service agreement for recurring service authorizes The Mowing Panda to continue performing and billing for the approved service at the agreed frequency and price until the service is canceled or modified.

Recurring landscape service does not mean identical work will be performed during every visit. Work and results may vary according to season, growth, weather, property conditions, and the services purchased.

Unless a fixed term is expressly stated in writing, recurring service does not create a long term commitment and may be canceled by either party subject to amounts already properly incurred.

16. Changes to Recurring Services

The Mowing Panda may propose changes to service frequency, scope, packages, or pricing.

Material changes will be communicated to the Customer before becoming effective when Customer acceptance is required.

Posting revised Terms on our website does not, by itself, retroactively change the Terms governing previously approved work.

17. Cancellation and Suspension of Service

Either party may discontinue recurring service unless a separate written agreement provides otherwise.

The Customer remains responsible for services already performed, approved additional work, authorized materials, and other amounts properly incurred before cancellation.

The Mowing Panda may suspend or discontinue service for nonpayment, unsafe conditions, inaccessible property, abusive or threatening conduct, repeated interference with service, or other circumstances that make continued service unreasonable or unsafe.

18. Payment

Payment is due within seven (7) days of the invoice date unless another due date is stated in writing.

Balances remaining unpaid after the due date may accrue a late charge of 1.5% per month or the maximum amount permitted by applicable law, whichever is less.

The Mowing Panda may suspend future service while an account remains past due.

Customers remain responsible for amounts properly due for services already performed and authorized materials or additional work.

19. Payment Methods and Recurring Payment Authorization

The Mowing Panda may accept payment through available payment methods communicated to the Customer.

When a Customer separately authorizes recurring or stored payment information, that authorization may be used to collect amounts properly due according to the applicable authorization and agreement.

The Customer is responsible for maintaining valid payment information where recurring payment authorization is used.

20. Payment Disputes and Chargebacks

Customers who believe a charge is incorrect should contact The Mowing Panda promptly so the matter can be reviewed.

Initiating a chargeback, payment dispute, or payment reversal does not eliminate a valid underlying payment obligation.

The Mowing Panda may provide estimates, approvals, invoices, photographs, communications, service records, and other relevant documentation to banks, payment processors, card networks, insurers, collection providers, courts, or other appropriate parties when reasonably necessary to establish or collect a valid obligation or respond to a dispute.

21. Satisfaction Guarantee

If a service does not reasonably conform to the approved scope of work, the Customer should notify The Mowing Panda promptly and provide a reasonable opportunity to inspect and address the concern.

After reviewing the circumstances, The Mowing Panda may provide corrective service or another reasonable remedy when appropriate.

The satisfaction guarantee does not create an unconditional entitlement to a refund, plant replacement, property replacement, repeated service, or compensation beyond the remedies otherwise available under the Customer’s agreement and applicable law.

22. Photographs and Service Documentation

The Mowing Panda may photograph or record service areas before, during, and after work for estimates, property condition documentation, quality control, training, service verification, safety, insurance, and dispute resolution.

Photographs or recordings that identify a Customer personally or show the interior of a residence will not be used for advertising without appropriate permission.

23. Customer Provided Information

The Customer is responsible for the accuracy of information and instructions provided to The Mowing Panda.

The Mowing Panda may reasonably rely upon information provided by the Customer or an authorized representative concerning property boundaries, ownership, access, landscaping, irrigation, utilities, service preferences, and other conditions relevant to the work.

24. Larger Projects and Project Specific Agreements

Projects involving installation, removal, significant landscape modification, machinery, substantial quantities of materials, excavation, grading, drainage work, demolition, or other elevated risks may require a separate Project Agreement or additional project specific terms.

Additional project specific terms supplement these Terms. If a project specific written provision directly conflicts with these general Terms, the project specific provision controls for that project.

Additional or materially changed work may require a written change order, revised estimate, or other written authorization before work proceeds.

Where applicable, projects will also be subject to mandatory notices and other requirements imposed by Florida law.

25. Materials, Measurements and Estimates

Unless expressly stated otherwise, measurements, quantities, coverage calculations, and material requirements used for estimating are reasonable estimates based upon observable property conditions and information available when the estimate is prepared.

Natural materials and living products may vary in color, size, texture, shape, density, appearance, and availability.

Reasonable natural variation does not constitute defective work.

Unforeseen site conditions or Customer requested changes may require additional labor, materials, or charges. Additional charges will be communicated for authorization when reasonably practicable before the additional work is performed.

26. Insurance

The Mowing Panda maintains insurance appropriate to its operations.

The existence of insurance does not constitute an admission of liability and does not expand The Mowing Panda’s contractual or legal responsibility.

Customers agree to cooperate reasonably with documentation, inspection, and applicable claims procedures when an incident may involve insurance.

27. Informal Dispute Resolution

If a dispute arises concerning services, payment, alleged damage, or these Terms, the Customer and The Mowing Panda agree to make a good faith effort to resolve the matter directly before filing a lawsuit, except where immediate legal action is reasonably necessary to preserve a legal right or obtain emergency relief.

Written notice should reasonably describe the dispute and requested resolution and may be sent to:

support@themowingpanda.com

Nothing in this section shortens any applicable statute of limitations or eliminates a legal right or remedy that cannot lawfully be waived.

28. Governing Law and Venue

These Terms and services provided by The Mowing Panda are governed by the laws of the State of Florida, without regard to conflict of law principles.

To the extent permitted by applicable law, any legal proceeding arising from services provided under these Terms will be brought in a court of competent jurisdiction in the Florida county where The Mowing Panda maintains its principal place of business, unless applicable law requires otherwise.

29. Website Use

The Mowing Panda website and its content are provided for informational and business purposes.

Text, graphics, photographs, videos, logos, designs, and other original content belonging to Great Name LLC or The Mowing Panda may not be copied, reproduced, distributed, or commercially exploited without permission except as permitted by law.

The website may contain links to third party websites. The Mowing Panda does not control and is not responsible for third party websites, their content, availability, security, or privacy practices.

Information displayed on the website does not modify a Customer’s approved scope of work unless expressly incorporated into the Customer’s agreement.

30. Privacy

Personal information is handled according to our Privacy Policy and applicable law.

Customer information may be used as reasonably necessary to provide services, communicate with Customers, administer accounts, process authorized payments, maintain business records, address disputes, prevent fraud, and comply with legal obligations.

31. Electronic Communications and Approvals

The Customer agrees that estimates, approvals, invoices, service communications, notices, and other business records may be provided electronically where permitted by law.

An electronic approval, signature, or other affirmative electronic acceptance may have the same legal effect as a handwritten signature to the extent provided by applicable law.

The Customer is responsible for providing accurate contact information.

32. Changes to These Terms

The Terms applicable to a service are the version incorporated into the Customer’s agreement when that agreement is approved, together with any later modification validly agreed to by the parties.

The Mowing Panda may revise these Terms prospectively.

Posting revised Terms on the website does not, by itself, retroactively change the agreement governing previously approved or completed work.

Each published version should display its effective date.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate, without invalidating the remaining provisions.

34. No Waiver

A failure or delay by either party in enforcing a provision of the agreement does not automatically waive the right to enforce that provision or another provision later.

35. Entire Agreement and Order of Priority

The Customer’s approved estimate, proposal, or service authorization, applicable written change orders or project specific agreements, and these Terms constitute the agreement concerning the approved services.

If a project specific written agreement directly conflicts with these Terms, the project specific agreement controls for that project.

If an approved estimate contains a specific provision that directly conflicts with a general provision of these Terms, the specific provision in the approved estimate controls for that service.
